Married couples and couples in domestic partnerships in Washington State can enter into a community property agreement where all of their property, both separately and jointly acquired, becomes community property upon the death of the first spouse or partner to pass away. There are two types – one allows you to identify and/or retain separately acquired property as separate property and not part of the marital community or domestic partnership. This agreement is designed to create 50/50 ownership in all property, whether acquired separately or as the marital community or domestic partnership, previously or in the future.
